General terms and conditions / event rooms Schloss Seefeld - Empeco Consulting GmbH

1. General

The premises of Empeco GmbH must be returned in their original condition after an event. 

The rental of the premises, the technical equipment and the furnishings of Empeco Consulting GmbH as well as the use of services for events takes place exclusively on the basis of the following general terms and conditions.

Conflicting terms and conditions of the customer do not apply. You are hereby expressly contradicted.

2. Rent

The rent is based on daily rates and refers to 10 hours from the start of the rental time discussed, e.g. from 8:00 a.m. and 6:00 p.m. The daily rates apply to the working days, Monday to Sunday.

For each additional hour started, an overtime surcharge of 15% of the daily rate will be charged. There is no entitlement to a longer transfer of use if the deadline is missed.

The price includes existing furnishings in the rooms.

3. Option / booking / cancellation

Options can be agreed verbally, bookings / firm bookings and cancellations of bookings must be made in writing via letter / email / fax. WhatsApp or SMS are not recognized.

If there is a second option for the period in which there is a 1st option, the 1st option has the option of booking the rooms within 24 hours, otherwise the first written booking has priority. An option must be confirmed as a firm booking no later than two working days (Monday to Friday) before the planned event by accepting and receiving (returning) a corresponding offer to conclude a contract. Otherwise it can be canceled by Empeco Consulting GmbH without prior consultation.

The rental takes place at the price to be specified in the booking, for the period specified there and with the additional services agreed in the booking, insofar as these can be freely selected.

In the case of cancellations received by EMPECO Consulting GmbH earlier than 14 working days (Monday to Friday) before the planned start of the event, 50% of the total costs will be charged; if the cancellation is later, 100% of the total costs will be invoiced and payable.

4. Additional services and costs

Additional services and costs are not included in the rent.

If EMPECO Consulting GmbH procures items from third parties and makes them available to the customer, these will be invoiced to the customer at the respective rental or acquisition costs plus a handling fee.

The costs for lost, destroyed or damaged items will be invoiced to the customer at the new price or in the amount of the proven repair costs plus a handling fee.

5. Payment terms

The rental price shown on the invoice and the additional amount for additional services within the meaning of No. 4 of the general terms and conditions is due for payment 10 days after receipt of the invoice without deduction by bank transfer.

New customers receive an advance invoice, which must be paid before the rental begins. All prices are net plus statutory VAT.

6. Terms of Use

The right of use is exclusively available to the customer or his customer. The subletting or transfer to third parties requires the prior written consent of EMPECO Consulting GmbH.

The customer undertakes to comply with the following terms of use (house rules). In addition, the customer undertakes to ensure that his vicarious agents and other persons who are in the premises during the event also comply with the terms of use.

• The rooms are rented in a clean condition and with the respective existing furnishings. There is no entitlement to the presence of certain furnishings.

• At the beginning of the rental period, the customer must ensure that the rental property is in order. If the correctness of the rental object is not complained about when it is handed over, it is deemed to have been accepted by the customer.

• The premises, including the floor and furnishings, are used for photography and for events. They are to be used for this purpose and treated carefully and with care.

• The use of the furnishings and the technical equipment takes place exclusively on the premises of EMPECO Consulting GmbH.

• The use of sand, artificial snow or similar is only permitted with prior written consent. Bringing animals requires prior approval.

• The use of materials and aids that could damage or contaminate the premises, the equipment or the furnishings or endanger people (e.g. attaching nails or similar to the floor or walls, flammable liquids, open Fire) is prohibited.

• It is forbidden to change the rented property.

• Any use contrary to the contract is excluded.

• EMPECO Consulting GmbH reserves the right of domicile and is entitled to enter the premises at any time itself or through its agents.

7. Customer Liability

The customer is liable for all damage caused by himself or his vicarious agents to the room and the entire outdoor area, its furnishings and borrowed equipment, as well as for the resulting costs (e.g. loss of rent).

8. Liability of EMPECO Consulting GmbH

EMPECO Consulting GmbH is liable for damage caused by it or its agents willfully or through gross negligence. Liability per case of damage is limited to twice the value of the agreed rent. Any further liability is excluded.

In particular, liability for damage to or theft of objects and equipment brought along (cloakroom, laptop, other valuables, etc.), liability for personal injury during the stay in the premises of EMPECO Consulting on the entire outdoor area as well as liability for damage, caused by third parties or force majeure.

9. Return of the rental object

The customer is obliged to tidy up the premises at the end of the rental period and to return the premises and rented equipment and furnishings in their original condition. Any additional cleaning work (sweeping, wiping, cleaning dishes, etc.) is carried out by EMPECO Consulting GmbH.

The handover takes place to a representative of EMPECO Consulting GmbH. For this purpose, he must be notified about half an hour before the end of the event. In the event of any damage to the rented property, a record of the type and extent of the damage must be drawn up and signed.

10. Withholding / offsetting

The customer's right to retention and set-off is excluded.

11. Final provisions

Changes and additions to the contract and these conditions must be made in writing. This also applies to the amendment or cancellation of the written form clause.

Should any provision of these general terms and conditions be or become ineffective, the remaining provisions shall nonetheless apply. The ineffective provisions will be replaced by another, effective one, as the contracting parties would have agreed upon with a reasonable consideration of the mutual economic interests at the time of the conclusion of the contract, if they had been aware of the ineffectiveness of the provision.

 

The place of jurisdiction is Munich.
